A prosecutor says no charges will be filed against a Grant County sheriff’s deputy who fatally shot a man during a confrontation last month.

The county’s district attorney, Lisa Riniker, found that Deputy Andrew Smith was justified in using deadly force.

Smith shot and killed Roger Helgerson Jr. in Millville on Sept. 1.

The DA said Helgerson had referred to having a shootout with law enforcement over a foreclosure. After a short chase, Helgerson got out of his car with a long gun and pointed it at Smith, who then shot Helgerson.

Riniker said Smith’s account was corroborated by his squad car video.

Smith was placed on standard administrative leave after the shooting. WISC-TV reports Sheriff Nate Dreckman said the sheriff’s office determined Smith did not violate any department policies.
