Superior City Councilor Waives Preliminary Hearing

A Superior City Councilor charged with pointing a gun at his fiancée during a domestic dispute waived his right to a preliminary hearing Wednesday.

Graham Garfield is charged with a felony and three misdemeanors for the April 20 incident. Douglas County District Attorney Mark Fruehauf said the waiver means that both parties agree there’s probable cause the events took place as detailed. He said Garfield is being charged with a felony in the dispute because the gun was loaded when he pointed it at another person.

“The fact that it’s a loaded weapon in combination with the other factors, the allegations, that amounts to reckless conduct that could seriously endanger someone’s life,” Fruehauf said.

Garfield’s attorney Chris Gramstrup told the Superior Telegram that his client declined to comment after the hearing. Garfield attended his first Superior City Council meeting Tuesday since the incident. He refused calls for him to step down in a statement on Tuesday, saying that it will be best for his district and the council that he continue to serve.

Garfield also said in the statement that he is now sober and attending AA meetings. His arraignment is set for May 26.
