The fatal shooting by a police officer of a suspect in downtown Milwaukee Wednesday appears to be the first test of a new state law that requires an outside agency to lead the investigation anytime a police officer is involved in a deadly shooting.
Milwaukee Mayor Tom Barrett says the state Justice Department’s Division of Criminal Investigation is in control of the review, and Barrett told a televised news briefing he’s comfortable with that.
“The Milwaukee Police Department on a regular basis undergoes an investigation and on a regular basis has outside bodies that also investigate it,” Barrett said, “so I feel very, very confident that there will be fabulous cooperation, and when I was at the scene earlier this afternoon, the state was already present there.”

Milwaukee police say the officer shot the suspect after a struggle. Police Chief Ed Flynn says the officer may have fired as many as ten bullets.
